Article 11 of the Cosmetic Regulations precisely defines the information that must be held in the PIF. Among them: evidence of the claimed effect.
Under Article 11.2.d, the PIF must contain “where justified by the nature or the effect of the cosmetic product, proof of the effect claimed for the cosmetic product.”
The PIF must contain evidence or at least a brief summary of the technical data or references to more detailed evidence information (if the data is not part of the PIF) necessary to support the claimed effects. This refers to any claim made for a cosmetic product, regardless of the means of communication or type of marketing tool used and regardless of the target audience (consumers, professionals, etc.).
The choice of the adequate and appropriate way to support a claim remains that of the Responsible Person. It depends on the type of product, packaging, claims and their context, etc. In cases where the effect is obvious (e.g. lipsticks for colouring lips or shampoos for washing hair), the PIF does not necessarily have to contain performance data.
Regarding claims on the absence of tests carried out on animals, reference should be made to the European Commission Recommendation of 7 June 2006.
