New restrictions for Dihydroxyacetone applicable to all products

This 22 April 2022 marks the entry into force of new restrictions under Regulation 2021/1099 for Dihydroxyacetone, particularly when used in non-oxidising hair dyes and self-tanners, including for products already on the market.

Regulation 2021/1099 of 5 July 2021 amended Annex III (restricted substances) to Cosmetics regulation 1223/2009 to define maximum concentrations of Dihydroxyacetone in finished products.

Since 26 January 2022, new products placed on the EU market must not contain this substance beyond:
• 6.25% in non-oxidative hair dye products
• 10% in self-tanning products

As of 22 April 2022, these provisions also apply to products already on the market. Any non-compliant products must therefore be removed from the market.

It is the responsibility of manufacturers and Responsible Persons to take all appropriate measures to meet these dates, including informing distributors and organising possible withdrawals of non-compliant products from the market.
