As every year, at the end of the Cosmetic Valley Perfumes & Cosmetics Congress held on December 1st and 2nd, 2021, the entire FEBEA team answered the questions prepared by the congressmen during the two days of conferences. A session marked by the implications of the French AGEC law, notably on “Biodegradable” and environmental claims, the sorting-nfo and the Green Dot, the modalities of bulk sales or the information on endocrine disruptors.

“Biodegradable” claim”

Question
Due to the implementation of the AGEC law, the claim “Biodegradable” will no longer be accepted for products and packaging. What about microplastics? The notion of biodegradability will no longer be allowed on the label?

Xavier Guéant’s answer
Article 13 of the AGEC law provides for a general ban on the claim “Biodegradable” applicable from 1 January 2022, and sanctionable from 1 January 2023. We are still waiting for the final version of the implementing decree of this Article 13. The industry is in a strategy to defend this claim, but in view of the exchanges with the authorities, the window of opportunity is extremely narrow and the possibility of making a claim on biodegradability seems quite compromised, at least in the near future. More generally on environmental obligations, work will begin in 2022 at the European level, in particular to revise the Directive on unfair commercial practices, and …
