HEMA/Hair dyes Reminder: new restrictions come into force

On 3 June 2021, two European Regulations are coming into force. Regulation 2020/1682 imposes new restrictions on the use of HEMA and di-HEMA TMHDC, and Regulation 2020/1683 does the same for several hair dye ingredients. Reminder of the new obligations.

HEMA / di-HEMA TMHDC

Regulation 2020/1682 of 12 November 2020 amended Annex III (Restricted Substances) to the Cosmetics Regulation 1223/2009, to add HEMA and di-Hema Trimethylhexyl Dicarbamate, to restrict their use to nail products for professional use only.
The products involved must be labelled “For professional use only” and “Can cause an allergic reaction”.
The provision comes into force as of 3 June 2021 for new products placed on the EU market. From 3 September 2021, all products not complying with these provisions must be removed from the market.

Hair dyes

Regulation 2020/1683 of 12 November 2020 has amended the regulation of 10 hair dye ingredients.
Three will join Annex II to the Cosmetics Regulation and will be banned from 3 September 2021.

New restrictions apply from 3 June 2021 for six others:
• Dimethylpiperazinium Aminopyrazolopyridine HCl - Maximum concentration: 2%
• Methylimidazoliumpropyl p-Phenylenediamine HCl - Maximum concentration: 2%
• HC Orange No.6 - Maximum concentration: 0.5%
• Acid Orange 7 - Maximum concentration: 0.5%
• Tetrabromophenol Blue - Maximum concentration: 0.2%
• Indigofera Tinctoria Leaf / Indigofera Tinctoria Leaf Powder / Indigofera Tinctoria Leaf Extract / Indigofera Tinctoria Extract - Maximum concentration: 25%
