The 4th European CMR Regulation notified to the WTO

The European Union transmitted to the WTO a draft Regulation aimed at banning or regulating substances classified as CMR by Regulation 2020/1182 (15th ATP to CLP), published in August 2020. On the programme: 23 new entries in Annex II (prohibited substances) of Cosmetics Regulation 1223/2009, including Zinc Pyrithione which is therefore deleted from Annexes III (restricted substances) and V (preservatives). The text also provides in particular for the prohibition of Butylphenyl Methylpropional (allergen) and Sodium Hydroxymethylglycinate (preservative).

The draft measure is required to enact the prohibition to use as cosmetic ingredients substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR) by Commission Regulation (EU) No.2020/1182, which has been adopted based on Regulation (EC) No.1272/2008 (the CLP Regulation) and will apply from 1 March 2022. The adoption of this draft Regulation is, therefore, needed to reflect inRegulation (EC) No.1223/2009(the Cosmetics Regulation) the new CMRs classification provided by Commission Regulation (EU) No.2020/1182, in order to ensure legal certainty and a high level of protection of human health.
