Europe notifies the 22nd ATP of the CLP

On 18 January 2024, the European Union transmitted to the WTO a draft Regulation which constitutes the 22nd ATP (Adaptation to Technical and Scientific Progress) of the CLP (Classification, Labelling and Packaging of Substances) Regulation. It involves a total of 17 substances that can be used in cosmetics, including four with a new CMR classification, which ultimately threatens their use in cosmetic products.

Content

The purpose of this draft proposal for an adaptation to technical progress of Regulation (EC) 1272/2008 on classification, labelling and packaging of substances and mixtures (the CLP Regulation) is to amend Table 3 of Part 3 of Annex VI to the CLP Regulation, by introducing new and revised entries for the harmonised classification and labelling of 42 substances or substance groups and by deleting one entry.

The “cosmetic” substances involved

This draft Regulation is based on the opinions formulated by the Risk Assessment Committee (RAC) of the European Chemicals Agency (ECHA) between 18 March 2022 and 1 December 2022 on the proposals for harmonised classification and labelling of certain substances.
