HEMA/Hair dyes Reminder: new restrictions come into force

This September 3, 2021 marks the entry into force of new restrictions provided for by European Regulations 2020/1682 (for HEMA and di-HEMA TMHDC) and 2020/1683 (for several hair dye ingredients). This is the second step in the implementation of the provisions of these texts. Reminder of the new obligations.

HEMA / di-HEMA TMHDC

Regulation 2020/1682 of 12 November 2020 amended Annex III (Restricted Substances) to the Cosmetics Regulation 1223/2009, to add HEMA (CAS 868-77-9, CE 212-782-2) and di-Hema Trimethylhexyl Dicarbamate (CAS 41137-60-4/72869-86-4, CE 255-239-5/276-957-5), to restrict their use to nail products for professional use only.
The products involved must be labelled “For professional use only” and “Can cause an allergic reaction”.
The provision came into force as of 3 June 2021 for new products placed on the EU market. From this 3 September 2021, all products not complying with these provisions must have been removed from the market.

Hair dyes

Regulation 2020/1683 of 12 November 2020 has amended the regulation of 10 hair dye ingredients.
New restrictions apply from 3 June 2021 for six of them.
Three join Annex II to the Cosmetics Regulation and are thus banned from 3 September 2021 in new products placed on the market:
• 1,2,4-Trihydroxybenzene (CAS 533-73-3, CE 208-575-1, INCI: 1,2,4-Trihydroxybenzene) when used as a substance in hair and eyelash dye products
• 4-Amino-3-hydroxytoluene (CAS 2835-98-5, CE 220-620-7, INCI: 6-Amino-m-cresol) when used as a substance in hair and eyelash dye products
• 2-[(4-Amino-2-nitrophenyl)-amino]-benzoic acid (CAS 117907-43-4, CE 411-260-3, INCI: 4-Amino-2-nitrodiphenylamine-2’-carboxylic acid) when used …
