Safety Gate opens up to consumers

Le Safety Gate s'ouvre aux consommateurs

Implementing Regulation 2024/1740, published in the Official Journal of the European Union on 24 June 2024, will enable consumers and other interested parties to report products that could pose a risk to health and safety directly to the Safety Gate portal. This measure has been taken in application of Regulation 2023/988 on general product safety.

The key points of Regulation 2024/1740

• The Safety Gate portal will be upgraded to allow consumers to report products they consider dangerous directly.
• The information supplied will be filtered automatically to check its relevance.
• Information that is found to be relevant will be forwarded to the Member States concerned so that they can take the necessary measures.
• Personal data supplied in this context will be stored in the portal for a maximum of five years.
• This Regulation will apply from 13 December 2024 (at the same time as Regulation 2023/988 on general product safety).

The “Whereas” of Regulation 2024/1740

(1) Regulation (EU) 2023/988 provides for the possibility for consumers and other interested parties to inform the Commission of products that might present a risk to the health and safety of consumers through a separate section of the Safety Gate Portal.

(2) The information mechanism to be specified by the Commission should consist of the modalities for sending the information by consumers, as well as the modalities for the transmission of such information to the national authorities concerned.
