Template for a recall notice: a corrigendum to European Regulation 2024/1435

Published in May 2024, Implementing Regulation 2024/1435 provides the model to be followed by product recall notices issued by companies to consumers. The European Commission has now added a further clarification on the instructions to be given to consumers.

Pursuant to Regulation 2023/988 on general product safety, Implementing Regulation 2024/1435, published in the Official Journal of the European Union on 27 May 2024, provides a single, standardised model for a recall notice, detailed both in its form and in the information it must contain, and valid for both in-store display and on an online shop.

On 24 July 2024, the European Commission published a corrigendum, adding an additional “whereas” and adapting the recall model accordingly.

The “whereas” added

The following text has been inserted:
“Consumers should be clearly informed about the safety precautions and actions they have to take as part of the recall. In particular, the recall notice should mention that the consumer should immediately stop using the recalled product. Experience shows that in certain cases this instruction may not be applicable, for instance where a car is still capable of a temporary limited operation and it is possible for the consumer to drive it to a repair shop under certain conditions; in such cases the recall notice should clearly specify under which conditions the product can still be used.”
