The Decree relating to the data of the Extended Producer Responsibility (EPR) channels, one of the declinations of the law relating to the fight against waste and the circular economy (AGEC law) was published in the Official Journal of the French Republic on 14 December 2022. It sets out the nature of the data and information that producers subject to the EPR principle and their eco-organisations must provide each year, as well as the procedures for making them available to ADEME and the public.
This Decree stipulates that eco-organisations and producers who have set up an individual system must henceforth transmit to the authority responsible for monitoring and observing EPR sectors (ADEME), by 30 April of each year (n) at the latest, information relating to the products they placed on the market the previous year (n-1).
This obligation is applicable from 2023 for data relating to 2022.
The information to be provided includes :
• Data relating to products placed on the market (ADEME may propose, in conjunction with the eco-organisations, to detail this information according to the product categories identified by the eco-organisations in their scales of financial contributions)
• Data on waste collection (quantity of waste collected per department, number of collection points per department)
• Data on waste management (quantities of waste treated expressed in tonnes, with data on sorting and recycling)
• Data on re-use and preparation for re-use of used products (quantity of products re-used or quantity prepared for re-use, quantity of products directed to another recovery method)…
