New hazard classes in CLP: the Regulation is published

On 31 March 2023, the European Commission published Delegated Regulation 2023/707 establishing new hazard classes in the CLP Regulation on classification, labelling and packaging of substances, and determining the criteria for the classification of endocrine disrupting substances (EDs), persistent, bioaccumulative and toxic (PBTs) and persistent, mobile and toxic (PMTs). The new classifications will apply from 1 May 2025 for substances and from 1 May 2026 for mixtures.

The key points of Regulation 2023/707

The text introduces several new classifications:
• Two “Endocrine Disruptor” classifications, one for human health, the other for the environment, Category 1 - known or presumed EDs, Category 2: suspected EDs
• Two “PBT” classifications for Persistent, Bioaccumulative and Toxic substances or mixtures and “vPvB” for very Persistent and very Bioaccumulative substances or mixtures
• Two classifications “PMT” for Persistent, Mobile and Toxic substances or mixtures, and “vPvM” for Very Persistent and Very Mobile substances or mixtures
The new classifications will apply from 1 May 2025 for substances and from 1 May 2026 for mixtures.

The classifications “Endocrine disruptor”

The definitions

• “Endocrine disruptor means a substance or a mixture that alters one or more functions of the endocrine system and consequently causes adverse effects in an intact organism, its progeny, populations or subpopulations.
• “Endocrine disruption” means the alteration of one or more functions of the endocrine system caused by an endocrine disruptor.
• “Endocrine activity” means an interaction with the endocrine system that may result in a response of that system, of target organs or target tissues, and that confers on a substance or the mixture the potential to alter one or …
