The 6th European CMR Regulation notified to the WTO

The European Union has just transmitted to the WTO a draft Regulation aimed at banning substances classified as CMR by Regulation 2022/692 (18th ATP to CLP), published in May 2022. On the agenda: 30 new entries in Annex II (prohibited substances) to Cosmetics Regulation 1223/2009, including seven for substances with an INCI name.

Key points of the draft Regulation

• This draft is the transposition into the Cosmetics Regulation of the classification as cosmetic ingredients of substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR) by Commission Regulation (EU) No.2022/692 (18th ATP to CLP).
• It involves a total of 30 substances, 7 of which have an INCI name.
• None of the substances concerned are currently listed in any of the annexes to the Cosmetics Regulation.
• No applications for use in cosmetic products on an exceptional basis have been submitted for the substances concerned.
• This draft foresees the prohibition of Benzophenone, Theophylline, Melamine, Azadirachta indica seed extract, Trimethylolpropane triacrylate, Pentetic acid, and Pentasodium pentetate.
• It will apply on the same date as the entry into force of the ATP it transposes, 1 December 2023.
