Cosmetics control authorities: the new French organisation

The principle was ratified at the end of 2022 by a provision inserted in the Finance Act for 2023 and will come into force gradually from 2024. At the “Perfumes & Cosmetics - Regulatory Issues” congress organised by Cosmetic Valley in Chartres on 8 and 9 November 2023, Virginie Gallerand, who is replacing Ambroise Pascal as head of the DGCCRF’s Health Products and Services Office, explained the details of the reform.

This reform follows a joint mission by the IGAS (General Inspectorate of Social Affairs) and the IGS (General Inspectorate of Finance), which submitted a joint report in 2020.
Its conclusions highlighted the inadequacies of the current organisation, which is too fragmented to ensure satisfactory market surveillance and effectively consolidate the vigilance essential to consumer safety”, Virginie Gallerand pointed out.

The scenario that has been adopted is that of a transfer of the competences currently exercised by the ANSM (National Agency for the Safety of Medicines and Health Products) to two entities:
• The ANSES, which will take over the tasks associated with risk assessment and those relating to cosmetovigilance
• The DGCCRF, which becomes the sole competent authority for cosmetics market surveillance, a task it previously shared with the ANSM.

In practical terms, the transfer of powers from the ANSM to the DGCCRF has three main components.

Declarations of establishment

The management of establishment declarations will change from 1ᵉʳ January 2024.
No change for establishments that have already been declared: the DGCCRF will take over the existing database and the ANSM archives and host it on its site.
