Cosmetics: the DGCCRF and Anses take control in France

Cosmétiques : la DGCCRF et l'Anses prennent le contrôle

The measure came into force on 1 January 2023, and the ANSM has now been relieved of some of its cosmetics control responsibilities in favour of the DGCCRF and the Anses. Some, but not all… The three agencies have each taken stock of the situation and clarified who is doing what from now on.

The principle of this transfer of powers was ratified at the end of 2022 by a provision inserted in the Finance Act for 2023, and therefore began to apply on 1 January 2023.
New division of tasks, new contacts for cosmetics companies… the three agencies took advantage of the start of the year to clarify matters.

The DGCCRF alone in charge of controls

From now on, the DGCCRF (General Directorate for Competition, Consumer Affairs and Fraud Control) will be solely responsible for inspecting cosmetic products and establishments, a task previously carried out jointly with the ANSM (National Agency for the Safety of Medicines and Health Products). And it assures it, this transfer of competences has little impact in practice for professionals in the sector.

Declarations of establishment
Cosmetics establishments still have to declare their activity on the “Démarches simplifiées” website.
Only the opening, modification and cessation of activities on or after 1 January 2024 need to be declared. If these procedures have already been carried out with the ANSM before this date, they do not need to be repeated.
