D4, D5, D6: the European Commission notifies new restrictions

D4, D5, D6 : la Commission européenne notifie de nouvelles restrictions

On 22 June 2023, the European Commission notified a draft amendment to the REACH Regulation. The proposed measure aims to extend to D6 the restrictions already applicable to D4 and D5 in wash-off cosmetic products, and to restrict in the same way the three substances in leave-on cosmetics. The text is due to be adopted by the end of 2023.

Key points of the draft Regulation

• To protect the environment from the very persistent and very bioaccumulative (vPvB) properties of D4, D5 and D6 and the persistent, bioaccumulative and toxic (PBT) properties of D4, the Commission plans to restrict their maximum concentration to 0.1% in several types of product.
• This restriction already applies to D4 and D5 in wash-off cosmetic products from 31 January 2020.
• For D6 in wash-off products, it will come into force 2 years after the text comes into force.
• For D4, D5 and D6 in leave-on cosmetics, it will come into force 3 years after the text enters into force.
• This text should be adopted by the end of 2023.
