It comes into force for products placed on the market this 31 July. Regulation 2022/1181 of 8 July 2022 amended the preamble to Annex V (authorised preservatives) of Cosmetics Regulation 1223/2009 to define the new threshold for labelling the presence of formaldehyde releasers.
Point 2 to the Preamble of Annex V to Regulation (EC) No.1223/2009 now reads as follows:
“All finished products containing substances which are listed in this Annex and which release formaldehyde shall be labelled with the warning”Releases formaldehyde” where the total concentration of formaldehyde released in the finished product exceeds 0.001% (10 ppm), irrespective of whether the finished product contains one or more substances releasing formaldehyde.”
This provision applies from 31 July 2024 for products placed on the market in the European Union.
It will apply from 31 July 2026 for products made available on the market.
It is the responsibility of manufacturers and Responsible Persons to take all appropriate measures to comply with these provisions.
