Information on the environmental characteristics of products: the French Decree is published

On 30 April 2022, the Decree “on consumer information on the environmental qualities and characteristics of waste generating products” was published in the Official Journal of the French Republic. It includes provisions applicable in particular to cosmetic packaging, most of which will come into force from 1 January 2023.

This Decree defines the conditions of application of a part of the law on the fight against waste and the circular economy (AGEC law), which provides for good information to consumers, more complete and framed, about the environmental impacts of the products they consume.

The scope of the Decree

According to this Decree, the environmental qualities and characteristics of waste-generating products are understood to be “the characteristics intended to inform the consumer about the conditions relating to better waste prevention and management.”
The products subject to the information obligation are “new products placed on the market for the consumer.”
Only producers, importers or any other marketers who declare a turnover of more than 10 million euros for the products they place on the national market and who are responsible for placing at least 10,000 units of these products on the national market each year are subject to this obligation.

Obligations applicable to the cosmetics sector

They apply to “packaging used to market products consumed or used by households, including those consumed away from home”, which includes packaging for cosmetic products.
