Publication of the French Decree on reused packaging

Publication du Décret sur les emballages réemployés

On 9 April 2022, the “Décret n°2022-507 du 8 avril 2022 relatif à la proportion minimale d’emballage réemplée à mettre sur le marché annuellement” (Decree n°2022-507 of 8 April 2022 on the minimum proportion of reused packaging to be placed on the market annually) was published in the Officiel Journal of the French Republic. The text sets progressive targets of up to -10% in 2027 and is applicable from 1 January 2023.

This Decree defines for the years 2023 to 2027 the minimum proportion of reused packaging to be placed on the market annually in France in order to achieve the reuse targets set by Article L. 541-1 of the Environmental Code, i.e. 5% in 2023 and 10% in 2027. It specifies the producers concerned and provides for the possibility for these producers to join together within a collective structure or to rely on their eco-organisation to fulfil their obligation to reuse packaging.

Définitions

Within the meaning of this Decree, the following definitions apply
1/ “Packaging” means packaging that meets the conditions specified in Article R. 543-43 (any object, whatever the nature of the materials of which it is made, intended to contain and protect goods, to enable them to be handled and transported from the producer to the consumer or user, and to ensure their presentation”);
2/ “Producer” means any person who professionally packages or causes to be packaged his products with a view to placing them on the market, any importer whose products are marketed in packaging or, if the producer or importer cannot be identified, the person responsible for first placing the products on the market;
