Brexit: European Commission updates its "Cosmetics" guidance

On 17 March 2020, the European Commission published an updated and extended version of the Brexit preparation aid leaflet for economic operators in the cosmetics sector. In addition to the points already addressed (the Responsible Person, the notification on the CPNP, the Product Information File, the labelling), new headings have been added to clarify the provisions to be taken regarding the safety assessor, products placed on the market before the end of the transition period or the specific case of Northern Ireland).

The European Commission has already published several versions of this guidance and advice note for companies affected by Brexit. This latest version has therefore been updated to take account of the confirmation of a transition period and has been supplemented by new chapters. Here is the full text.

Notice to stakeholders - Withdrawal of the United Kingdom and EU rules in the field of cosmetic products

Since 1 February 2020, the United Kingdom has withdrawn from the European Union and has become a “third country”. The Withdrawal Agreement provides for a transition period ending on 31 December 2020. Until that date, EU law in its entirety applies to and in the United Kingdom.
During the transition period, the EU and the United Kingdom will negotiate an agreement on a new partnership, providing notably for a free trade area. However, it is not certain whether such an agreement will be concluded and will enter into force at the end of the transition period.
