Following the amendments to the Cosmetic Regulations, which came into force on 9 October 2024, Health Canada has announced the availability of a guide and a new form to meet the new product notification requirements.
The “Regulations Amending Certain Regulations Concerning the Disclosure of Cosmetic Ingredients” was published on 24 April 2024 in the Canada Gazette.
Some of the changes it introduced came into force on 9 October 2024.
The new provisions
The changes that have come into force concern the following points in particular:
• Greater flexibility for the disclosure of ingredients for cosmetics sold in small packages
• Clarifying terminology and improving the level of detail for information submitted in a cosmetic notification (clarify the definition of “manufacturer”, require that the information about whether the cosmetic is “rinse-off” or “leave-on”, require that ingredients be identified by their INCI names, amend the table of concentration ranges, modernize the contact information present on the label…)
• Enhancing compliance and enforcement oversight with regard to who is responsible for responding to evidence of safety requests for cosmetics…
