Corrigendum to Regulation 2022/692 (18th ATP of the CLP)

Rectificatif au Règlement 2022/692 (18e ATP du CLP)

On 25 May 2022, the Commission published a Corrigendum to Delegated Regulation (EU) 2022/692 of 16 February 2022, which constitutes the 18th ATP (Adaptation to Technical and Scientific Progress) of the CLP Regulation (Classification, Labelling and Packaging of Substances). This corrigendum is not insignificant as it concerns the date of application of the text.

The Corrigendum to Commission Delegated Regulation (EU) 2022/692 of 16 February 2022 was published in the Official Journal of the European Union on 25 May 2022.
It consists of a single paragraph:
On page 4, Article 2, second paragraph
for: “It shall apply from 23 November 2023.”,
read: “It shall apply from 1 December 2023.”

Even if this small delay of one week may not seem to have much impact, it is important because the date of application of the ATP is always correlated to the date of the “CMR” Regulation which transposes it into the Cosmetics Regulation 1223/2009.
It is therefore on 1 December 2023 that several cosmetic ingredients among the seven classified by this ATP as CMR (Benzophenone, Theophylline, Melamine, Azadirachta Indica Seed Extract, Trimethylolpropane Triacrylate, Pentetic Acid, Pentasodium Pentetate) could be definitively banned from use in cosmetic products.
