Europe notifies a new UV filter approval to the WTO

L'Europe notifie l'autorisation d'un nouveau filtre UV à l'OMC

On 12 March 2020, the European Union transmitted to the WTO a draft Regulation to authorise the use of a new UV filter, Methoxypropylamino Cyclohexenylidene Ethoxyethylcyanoacetate (S87), in cosmetic products. The modification of Annex VI (authorized UV filters) of Cosmetics Regulation 1223/2009 is expected to be adopted in the 4th quarter of 2020.

The draft Commission Regulation aims at allowing the use of Methoxypropylamino Cyclohexenylidene Ethoxyethylcyanoacetate (S87) as a UV filter in cosmetic products at a concentration up to 3%, by adding it to the list of authorised UV filters in Annex VI to Regulation (EC) No 1223/2009.

Whereas

  1. The Scientific Committee on Consumer Safety (SCCS) concluded in its Opinion of 13 December 2019 (“the SCCS Opinion”) that the use of Methoxypropylamino Cyclohexenylidene Ethoxyethylcyanoacetate as a UV filter in cosmetic products at a maximum concentration of 3% is safe. Inhalation toxicity was not assessed in the SCCS Opinion because no data were provided. Hence, the SCCS Opinion is not applicable to any cosmetic product in form of spray that could lead to exposure of the end user’s lung by inhalation.

  2. The SCCS also concluded in its Opinion that Methoxypropylamino Cyclohexenylidene Ethoxyethylcyanoacetate is a secondary amine, and thus is prone to nitrosation and formation of nitrosamine. …
