French draft order on data from EPR channels

On 7 June 2022, the French Ministry of Ecological Transition launched a public consultation on a draft Order relating to the data of extended producer responsibility (EPR) channels. This is one of the declinations of the law on the fight against waste and the circular economy (AGEC law), which provides for various reporting mechanisms to improve the transparency of EPR channels.

The AGEC law stipulates in particular that producers subject to the EPR principle and their eco-organisations must transmit certain information each year to the authority responsible for monitoring and observing EPR channels, i.e. the Agency for the Environment and Energy Management (ADEME), as well as to the regions responsible for drawing up and monitoring the regional waste prevention and management plan.

The aim of this draft Order is to harmonise the information necessary for monitoring and observing EPR channels and the methods of transmitting it.
It includes :
• A section common to all EPR channels, setting out:
-> the list of information transmitted by producers and eco-organisations to ADEME, relating to products placed on the market, waste collected and treated, reuse and preparation for reuse of used products, their repair, as well as the exercise of eco-organisations
-> the list of information made available to the public by ADEME and by the eco-organisations
-> the list of information transmitted directly to the Regions by the eco-organisations
-> the timetable and procedures for the transmission of this information
• Fifteen annexes detailing for each EPR channel (including household packaging) the specific additional data to be transmitted.
