Great Britain to align with the 14th and 15th ATPs of the European CLP

The HSE (Health and Safety Executive), the agency responsible for the CLP Regulation in GB, has just announced its intention to align itself with the 14th and 15th ATPs (Adaptations to Technical and Scientific Progress) of the European CLP. A total of 90 substances are involved.

As the HSE explains, the European CLP Regulation was transposed into GB regulations at the end of the Brexit transition period, i.e. as it stood on 31 December 2020. Two European ATPs, which subsequently came into force (the 14th on 1 October 2021, and the 15th on 1 March 2022), were therefore not taken into account.

The HSE is today proposing an update of the GB CLP to include the 90 substances concerned (new or modified).
The classification and labelling requirements will thus be the same as in Europe, except for two substances, titanium dioxide in powder form and granulated copper, for which, according to the Agency, “additional information requires further assessment.”

Once validated, the HSE’s recommendation to the relevant Ministries should come into force in April 2024.

As a reminder, Great Britain has already proceeded in the same way for the 17th and 18th European ATPs in October 2023.
