Information on endocrine disruptors: the application decree for France

Informations sur les perturbateurs endocriniens : le décret d'application

Published in the Journal Officiel de la République Française of August 25, 2021, Decree No.2021-1110 sets out the terms and conditions for the provision of information to identify endocrine disruptors in a product placed on the market, as provided for in the French Law on Anti-Waste and Circular Economy (known as the AGEC Law). It will come into force on January 1, 2022, but still needs to be completed by an order setting the list of substances with endocrine disrupting properties.

As recalled in its explanatory note, this decree stems from Article 13 of the AGEC law, which provides that “Any person who places on the market products which, at the end of their manufacture, contain substances whose endocrine disrupting properties are qualified as proven or presumed by the French National Agency for Food, Environmental and Occupational Safety (ANSES) shall make available to the public electronically, in an open format, easily reusable and exploitable by an automated processing system, for each of the products concerned, the information allowing to identify the presence of such substances in these products”.
The stated aim of this measure is to ensure that citizens are provided with transparent information on the presence of substances with endocrine disrupting properties in products, as well as to allow collaborative platforms to exploit this information in order to better inform the consumer.
As foreseen by the AGEC law, this decree sets the terms of application of this new obligation.
