The Delegated Regulation (EU) 2024/197 of 19 October 2023 has been published in the Official Journal of the European Union on 5 January 2024. It is the 21st ATP (Adaptation to Technical and Scientific Progress) of the European CLP Regulation (Classification, Labelling and Packaging of substances). It concerns a total of 16 ingredients that can be used in cosmetics, and in particular one that is classified as a CMR, which threatens its use in cosmetic products in the future, and another whose classification as Repr. 2 becomes Repr. 1B. This Regulation shall apply from 1st September 2025.

This Regulation is based on the opinions adopted by the Risk Assessment Committee (RAC) of the European Chemicals Agency (ECHA) between 18 March 2021 and 26 November 2021.
It concerns a total of 16 substances that may be used in cosmetic products (listed in the CosIng, not present in Annex II of the Cosmetics Regulation, which lists prohibited ingredients): among the eight that are joining the CLP Regulation for the first time, one (Dimethyltolylamine) is concerned by a classification as CMR, which, in accordance with Article 15 of European Cosmetics Regulation 1223/2009, paves the way for a possible ban on its use in cosmetics. Another (TPO) has seen its classification as Repr. 2 become Repr. 1B.
