Reminder: entry into force of S.I 2023/764 in Great Britain

Statutory Instrument 2023 No. 764, entitled The Cosmetic Products (Restriction of Chemical Substances) Regulations 2023, comes into force on 6 July 2024. It introduces restrictions on the use of Methyl-n-Methylanthranilate and authorises bis-(Diethylaminohydroxybenzoyl Benzoyl) Piperazine (HAA299) as a UV filter.

The measure was notified in April 2023 and now comes into force. Great Britain is thus bringing itself into line with the provisions already applicable in Europe.

Methyl-n-Methylanthranilate

Methyl-n-Methylanthranilate (CAS No.85-91-6, EC No.201-642-6, CosIng function: Fragrance) is allowed up to 0.1% in leave-on products and 0.2% in rinse-off products.
In leave-on products, it is prohibited in sunscreen products and products marketed for exposure to natural or artificial UV light.
In any case, it should not be used with nitrosating agents and should be kept in nitrite-free containers. The maximum nitrosamines content is set at 50 μg/kg. This measure comes into force on 6 July 2024 for products placed on the market. It will apply from 6 July 2026 for products made available on the market.
The same provisions are fully applicable from 21 November 2022 in Europe.

Bis-(Diethylaminohydroxybenzoyl Benzoyl) Piperazine (HAA299)

Bis-(Diethylaminohydroxybenzoyl Benzoyl) Piperazine (CAS no.919803-06-8, EC No.-, CosIng function: UV filter) is added to the list of authorised UV filters with the following conditions:
• Maximum concentration for the non-nano form and for the nano form: 10%
• In case of combined use of the non-nano form and the nano form, the sum shall not exceed 10%
