Reminder: entry into force of the 5th CMR Regulation (and 17th ATP to CLP)

Rappel : entrée en application du 5e Règlement CMR (et de la 17e ATP au CLP)

This Saturday 17 December 2022 marks the entry into force of Regulation 2022/1531, the 5th annual text aimed at banning or regulating substances recently classified as CMR by Regulation 2021/849 (17th ATP of CLP), applicable on the same date. Reminder of the new obligations.

Prohibited ingredients

14 new entries are added to Annex II (prohibited substances) of the Cosmetics Regulation 1223/2009.
Among them, two have an INCI name:
• Methylene Di-t-Butylcresol (No.CAS: 119-47-1; No.EC: 204-327-1 ; CosIng function: antioxidant),
• MIBK (No.CAS: 108-10-1; No.EC: 203-550-1; CosIng functions: denaturant, perfuming, solvent)
Both are therefore now banned from use in cosmetic products, whether they are placed or made available on the market. Products still on the market that contain them must therefore be withdrawn as soon as possible.

Methyl Salicylate

Methyl Salicylate (No.CAS: 119-36-8; No.EC: 204-317-7; CosIng functions: denaturant, flavouring, oral care, perfuming, soothing) is added in Annex III (restricted substances) and is subject to new maximum concentrations:
• Leave-on skin products (except face makeup, spray/aerosol body lotion, spray/aerosol deodorant and hydroalcoholic-based fragrances) and leave-on hair products (except spray/aerosol products): 0.06%
• Face makeup (except lip products, eye makeup and makeup remover): 0.05%
• Eye makeup and makeup remover: 0.002%
• Leave-on hair products (spray/aerosol): 0.009%
• Deodorant spray/aerosol: 0.003%
• Body lotion spray/aerosol: 0.04%
• Rinse-off skin products (except hand wash) and rinse-off hair products: 0.06%
• Hand wash: 0.6%
• Hydroalcoholic-based fragrances: 0.6%
• Lip products: 0.03%
• Toothpaste: 2.52%
