On 14 December 2016, the European Commission has launched a public consultation on its proposal to make regulations evolve as regard the cosmetic ingredients Tagetes (extracts and essential oils). This project aims to include them in the Annexes II and III (banned and restricted substances) to Cosmetics Regulation. This consultation will remain open until March 18, 2017.
This consultation concern 'any interested parties, including authorities of the EU countries, manufacturers of cosmetic products, producers of the substances concerned and relevant industry and consumers' associations. '
Background
I. Tagetes erecta extracts and essential oils
Tagetes erecta extracts and essential oils (CAS numbers: 90131-43-4) are fragrance ingredients currently not regulated in Regulation (EC) No 1223/2009 on cosmetic products.
On 21 June 2005, the Scientific Committee on Consumer Products (SCCP) adopted an opinion on Tagetes erecta, T. minuta and T. patula extracts and oils (phototoxicity only).
For Tagetes minuta and Tagetes patula new data submitted by the industry have resulted in the Opinion of 2015, see under point II.
On Tagetes erecta, the SCCP concluded in its Opinion of 2005 that
'as no safe limits in cosmetic products have been demonstrated, it is recommended that Tagetes erecta extracts and oils (…) should not form part of cosmetic products'

II. Tagetes minuta and Tagetes patula extracts and essential oils
Tagetes minuta and Tagetes patula extracts and essential oils with (CAS numbers: 91770-75-1; 91722-29-1) are fragrance ingredients currently not regulated in Regulation (EC) No 1223/2009 on cosmetic products.
