Two orders have been just released in the French Journal Officiel, number 0054 issued on 5 March, to adapt the French law to the Annexes of the European Cosmetics Directive. As a result: a prohibited ingredient, 27 ingredients subjected to restrictions, and two more for which conditions for use have been modified.
The 27 February 2013 order concerns the list of the substances that cannot be used in cosmetic products. It transposes the Directive 2012/21/EU, which modifies the Annex II of the Cosmetics Directive.
Now in the list of ingredients banned in cosmetics:
• HC Red N° 16 (CAS: 160219-76-1) – Hair dye
The other order, also signed on 27 February 2013, concerns the list of substances that cannot be used in cosmetic products except when compliant with the restrictions and conditions specified in this list. It transposes the Directive 2012/21/EU, which modifies the Annex II of the Cosmetics Directive.
Now listed as ingredients subjected to restrictions:
• N, N-bis (2-Hydroxyethyl)-p-Phenylenediamine Sulfate (CAS: 54381-16-7) – Ingredient used in oxidative hair dyes
Restriction: maximum concentration on hair: 2.5% (as sulfate) – a substance subject to nitrosation*
• 4-Chlororesorcinol (CAS: 95-88-5) – Ingredient used in oxidative hair dyes
Restriction: maximum concentration on hair: 2.5%
• Tetra aminopyrimidine Sulfate (CAS: 5392-28-9) – Ingredient used in oxidative and non-oxidative hair dyes
Restriction: maximum concentration in the finished product 3.4% (as sulfate) – maximum concentration on hair 3.4% (as sulfate)
