Canada consults on changes to the regulation of 19 cosmetic ingredients

On 13 July 2023, Health Canada opened a consultation on 19 amendments to the Cosmetic Ingredient Hotlist. On the agenda are two bans and a total of 17 changes to existing restrictions. The comment period runs until 11 October 2023.

The proposed new prohibitions

Basic Green 4 (malachite green and its salts)
Ingredient involved
• INCI: Basic Green 4 - CAS: 569-64-2
Health Canada’s explanation
• It is proposed to add this ingredient to the list of prohibited due to potential developmental effects.
Regulations in Europe
• Basic Green 4 is listed un entry 1188 of Annex II (prohibited substances) to the Cosmetic Regulation 1223/2009.

Thioglycolic acid esters
Ingredients involved
• INCI: Glyceryl Thioglycolate - CAS: 30618-84-9
• INCI: Isooctyl Thioglycolate - CAS: 25103-09-7
Health Canada’s explanation
• Increased skin sensitization. Glyceryl thioglycolate can remain on permed hair for at least three months after the procedure. Continuous exposure increases the risk for developing skin sensitization and long-lasting dermatitis for people who are already sensitized. Health Canada proposes this substance be described as prohibited since a health protective limit cannot be calculated.
Regulations in Europe
• Thioglycolic acid esters are regulated under entry 2b of Annex III (restricted substances) to Cosmetics Regulation 1223/2009. Their maximum concentration in hair waving or straightening products is limited to 8% for general use and 11% for professional use, with a PH of 6 to 9.5.
