Great Britain: consultation on 3 CLH classification proposals

Grande-Bretagne : consultation sur 3 propositions de classification CLH

On 8 October 2024, the HSE (Health and Safety Executive), the Agency responsible for the CLP Regulation in Great Britain, opened consultations on its classification proposals for four ingredients used in cosmetics: Butoxyethanol, Pentetic Acid and Pentasodium Pentetate, and Silica Silylate. These consultations are open until 6 December 2024.

If the process is completed unchanged, the classification proposals put out to consultation will result in an alignment with those already adopted by the European Union.

Butoxyethanol
Delegated Regulation (EU) 2022/692](@@LINK-68425@@) (18th ATP of CLP) published on 3 May 2022 and applicable from 1 December 2023, amended the classification of Butoxyethanol (CAS No.111-76-2, EC No.203-905-0) as follows:
• Acute Tox. 3 (instead of Acute Tox. 4), H331 - Toxic if inhaled
• Acute Tox. 4, H302 - Harmful if swallowed
• Skin Irrit. 2, H315 - Causes skin irritation
• Eye Irrit. 2, Causes serious eye irritation
The HSE’s proposal is to make the same change.

Pentetic Acid and Pentasodium Pentetate
The same 18th ATP added the classification Repr. 1B, H360D - May damage the unborn child to the existing classifications for the two substances, Pentetic Acid (CAS No.67-43-6, EC No.200-652-8) and Pentasodium Pentetate (CAS No.140-01-2, EC No.205-391-3).
Following this classification, both ingredients were banned from use in cosmetics by Delegated Regulation (EU) 2022/692 (6th European CMR Regulation), also applicable from 1 December 2023.
The HSE’s proposal is to add this same classification Repr. 1B, H360D - May damage the unborn child for both substances.
