New Zealand: major update of cosmetics regulations... and a ban on PFAS

On 30 January 2024, the EPA (Environmental Protection Authority) announced the update of the Cosmetic Products Group Standard, the regulations applicable to cosmetic products in New Zealand. On the agenda: a number of alignments with European Cosmetics Regulation 1223/2009, as well as a few “additional” measures, such as a ban on PFASs by the end of 2026.

“New Zealand is one of the first countries in the world to take this step on PFAS – often described as ‘forever chemicals’ – to further protect consumers and the environment.”
So begins the press release issued by the EPA.

The New Zealand Authority points out that these substances can be used in nail polish, shaving cream, foundation, lipstick and mascara. “We know these chemicals don’t easily break down, they can build up in our bodies, and some can be toxic at high levels,” says Dr Shaun Presow, Hazardous Substances Reassessments Manager. “International research suggests PFAS are only found in a small number of products, but we take a precautionary approach to potential risks from PFAS. Banning these chemicals in cosmetics is part of our ongoing response […].”

The definition established for PFAS is aligned with that proposed by ECHA in its restriction proposal for Europe. However, the EPA has not adopted the concentration limits set by the European Agency.
The measure, applicable to all cosmetic products containing PFAS, will apply in three stages:
• 31 December 2026: ban on import and manufacture
• 31 December 2027: ban on sales
• 30 June 2028: disposal of products
