The European Union transmitted to the WTO a draft Regulation aimed at banning or regulating substances classified as CMR by Regulation 2020/217 (14th ATP to CLP), published in February 2020. On the programme: 12 new entries in Annex II (prohibited substances) of Cosmetics Regulation 1223/2009, and two amendments to Annex III (restricted substances), to add Titanium dioxide and modify the restrictions on Salicylic acid.

The draft measure is required to enact the prohibition to use as cosmetic ingredients substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR) by Commission Delegated Regulation (EU) 2020/217, which has been adopted based on the CLP Regulation and will apply from 1 October 2021. The adoption of this draft Regulation is, therefore, needed to reflect in the Cosmetics Regulation the new CMRs classification provided by Commission Delegated Regulation (EU) 2020/217, in order to ensure legal certainty and a high level of protection of human health
