Sales surface area for non-pre-packaged products: consultation on French draft decree

France has just launched an online public consultation on the draft decree on the development of the sale of non-pre-packaged products, particularly in bulk, in retail outlets of more than 400 m2. You can contribute until 17 February 2025.

This draft decree has been drawn up in application of Article 23 of Law 2021-1104, known as the Climate and Resilience Law, which stipulates that “by 1 January 2030, retail outlets with a surface area of 400 square metres or more shall devote to the sale of products presented without primary packaging, including sales in bulk, either at least 20% of their sales area of mass-market products, or an arrangement with an equivalent effect expressed in terms of number of references or proportion of turnover.”

The draft text specifies the methodology to be used by these retailers to measure the development of this sales method.
• It states that the sales area for FMCG products taken into account is the floor area of each establishment dedicated to the display and sale of FMCG products.
• It excludes from the calculation base products that cannot be sold in bulk for public health or legal reasons.
• It introduces a modulation for the sales area devoted to the sale of three product categories: alcoholic beverages, cosmetics and detergents. Only 75% of the sales area devoted to each product category is taken into account. It thus takes account of information gathered during a …
