Changes to EU eco-label criteria for cosmetics

Modification des critères d’attribution du label écologique de l’UE pour les cosmétiques

Published in the Official Journal of the European Union on 26 July 2023, Commission Decision 2023/1540 amends the EU Ecolabel criteria for cosmetic products and animal care products. This amendment to Decision 2021/1870 is intended to clarify certain provisions that could be interpreted in different ways.

Following the publication of Decision 2021/1870 establishing the EU Ecolabel criteria for cosmetic products and animal care products,
industry stakeholders indicated that some of its provisions could be interpreted in different ways, which could lead to inconsistencies in its practical implementation.
This text is intended to address this problem by clarifying several points.

Definition of active content
“Active content” (AC) means now : the sum of organic ingoing substances in the product, expressed in grams, calculated on the basis of the complete formulation of the final product, but without the water content of the ingredients and the organic rubbing/abrasive agents.

Excluded and restricted substances
• Unless stated otherwise (in particular for surfactants and Sodium Fluoride) or exempted, the product shall not contain substances at or above the concentration of 0.0100 % weight by weight for rinse-off products and 0.0010% weight by weight for leave-on cosmetics that meet the criteria for classification with the hazard classes H300, H301, H310, H311, H330, H331, H304, EUH070, H370, H371, H372, H373, H317, H334, H400, H410, H411, H412, H413 et H420.
