After many delays, the first Regulation aimed at formally integrating CMRs into Cosmetics Regulation 1223/2009 was finally published in May 2019. The European Commission had announced its intention to update the list of classified substances every year. And the movement is well and truly underway since on 12 June 2019, the European Union transmitted to the WTO a draft Regulation aimed at prohibiting or restricted all substances classified in 2018. The amendments to Annexes II, III and V of Cosmetics Regulation 1223/2009 are expected to be adopted in the 4th quarter of 2019.

This draft Commission Regulation aims at prohibiting or restricting the use in cosmetic products of all substances which have been classified in 2018 as carcinogenic, mutagenic or toxic for reproduction (CMR) by Commission Regulation (EU) No.2018/1480 amending for the purposes of its adaptation to technical and scientific progress Regulation (EC) No.1272/2008 on classification, labelling and packaging of substances and mixtures.

Whereas

1. Regulation (EC) No.1272/2008 of the European Parliament and of the Council provides for a harmonised classification of substances as carcinogenic, mutagenic or toxic for reproduction (CMR) based on a scientific assessment by the Risk Assessment Committee of the European Chemicals Agency. The substances are classified as CMR substances of category 1A, CMR substances of category 1B or CMR substances of category 2 depending on the level of evidence of their CMR properties.
