On 14 October 2021, the European Union transmitted to the WTO a draft Regulation to introduce new use restrictions for two UV filters, Benzophenone-3 and Octocrylene. The amendments to Annex VI (authorized UV filters) to Cosmetics Regulation 1223/2009 are expected to be adopted in the 2nd quarter of 2022.

Content

The draft Commission Regulation aims at amending the existing restrictions for Benzophenone-3 and Octocrylene, taking into account the latest Opinions by the Scientific Committee on Consumer Safety (SCCS) of 30-31 March 2021 on these two UV-filters. In particular, lowering the current maximum concentrations for Benzophenone-3 of 6% to 2.2% when used in body products, including propellant and pump spray products, and for Octocrylene of 10% to 9% when used in propellant spray products.

Whereas

  1. The substances 2-Hydroxy-4-methoxybenzophenone/Oxybenzone (CAS No.131-57-7), which has been assigned the name Benzophenone-3 under the International Nomenclature of Cosmetic Ingredients (INCI), and 2-Cyano-3,3-diphenyl acrylic acid, 2-ethylhexyl ester/Octocrylene (CAS No.6197-30-4), which has been assigned the name Octocrylene under the INCI, are currently allowed as UV-filters in cosmetic products and listed in entries 4 and 10, respectively, of Annex VI to Regulation (EC) No.1223/2009.
