May 14 -"Argane" is not a brand Pierre Fabre Dermo-Cosmétique presented itself as the owner of the Argane brand, registered in 1983 and under which it markets a range of products. She accused Clairjoie of launching a product called"shea-argane" on the market and assigned her for counterfeiting. After losing at first instance (2010) and on appeal (2013), Pierre Fabre had appealed. The highest French judicial body has just considered that'this term constituted the necessary and generic designation of a plant substance used for hygiene and skin care which should remain at the free disposal of the actors of the economic activity concerned wishing to introduce it into the composition of their products'. The mark was declared invalid and Pierre Fabre was dismissed and ordered to pay the costs.
