France: the nano-declaration, in practice

It is a purely French special feature, mandatory since 1 January 2013. The yearly declaration of the substances as nanoparticles shall be submitted no later than the 1 May. Applicable to all the sectors of the industry, it concerns also the cosmetics sector. For its first edition, the target date has been postponed by two months. Aurélie Niaudet, from the ANSES, presented, during the Cosmed 7th Cosmed Regulatory Meetings, on 11 June 2013, the practical way to do it.

The French nano-declaration has been implemented by the Grenelle de l’Environnement” Meeting. The first law, dated 3 August 2009, has been more precisely defined by the Grenelle II law, dated 12 July 2010. The relevant articles in the laws allow for:
• The knowledge of the materials: identity, quantities, uses
• Traceability: from the manufacturer or the importer down to the distributor to the final professional user
• The collecting every knowledge on the nano-materials in order to assess the risks and the pieces of information to provide the general public with

The principles of this declaration

The declaration is submitted to the Ministry of the Environment, and the National Agency for sanitary safety of food and environment and for occupational safety (ANSES) is in command of the management of the declarations and of their contents.
The scope has been defined by a decree, and is now a part of the Environment Code (Articles R.523.12 to D.523.22).
