The postponement by one year of the entry into force of Regulation (EU) 2023/1115 “on the making available on the Union market and the export from the Union of certain commodities and products associated with deforestation and forest degradation” had been agreed but not yet legally formalised. This was achieved with the publication of Regulation (EU) 2024/3234 in the Official Journal of the European Union on 23 December 2024.
After the political agreement on the European Commission proposal to postpone by one year the date of entry into force of the”Deforestation-free” Regulation, all that was needed for it to become effective was for it to be formally adopted before the end of 2024.
This has now been achieved with the publication of Regulation (EU) 2024/3234.
In view of the urgency of the matter, it entered into force on the third day following that of its publication, so as to ensure that this entry into force preceded the initial date of application of Regulation (EU) 2023/1115, which was set for 31 December 2024.
It sets out the new dates on which the various measures will come into force:
• The Commission now has until 30 June 2025 to publish the list of countries or parts of countries that present a low or high risk
• Regulation (EU) 995/2010 will continue to apply until 31 December 2028 for timber and timber products produced before 29 June 2023 and placed on the market from 30 December 2025
• The “Deforestation-free” Regulation will apply from 30 December 2025, except for operators who were established as micro-undertakings or small undertakings by 31 December 2020, …
