Public access to PIF information

All information contained in the PIF is the property of the Responsible Person and does not have to be made public. However, some of them must be made available to the public.

Article 21 states: “Without prejudice to the protection, in particular, of commercial secrecy and of intellectual property rights, the Responsible Person shall ensure that the qualitative and quantitative composition of the cosmetic product and, in the case of perfume and aromatic compositions, the name and code number of the composition and the identity of the supplier, as well as existing data on undesirable effects and serious undesirable effects resulting from use of the cosmetic product are made easily accessible to the public by any appropriate means.”

All the information contained in the PIF is the intellectual property of the Responsible Person (or of other parties, depending on contractual arrangements) and it is to be made readily accessible to the competent authority upon request.
The PIF is not to be made public. However, some of the information contained in it needs to be made accessible to the public.

What information needs to be made accessible to the public?

Product identification
Product name and company name should be clearly identifiable.

Qualitative and quantitative composition of the product
It is the list of ingredients, as labelled on the cosmetic package.
