14th and 15th ATP in the CLP: Great Britain's line-up is (almost) perfect

On 27 June 2024, the Health and Safety Executive (HSE), the agency responsible for the CLP Regulation in the Great Britain, announced that the ministerial decision aligning the UK CLP with the 14th and 15th ATPs of the European CLP Regulation would come into force on 26 June. As previously explained by the HSE, the European CLP Regulation was transposed into GB regulation at the end of the Brexit transition period, i.e. as it stood on 31 December 2020. Two European ATPs, which subsequently came into force (the 14th on 1 October 2021, and the 15th on 1 March 2022), were therefore not taken into account.

This difference between British and European legislation has now been bridged, with this ministerial decision, which sets out the classifications of 88 substances (including all those concerning ingredients that can be used in cosmetics, such as Geraniol, Sodium hydroxymethylglycinate or neem extracts), as they are in Europe.
However, two have not been included:
• The classification of Titanium Dioxide as Carc.2, effective in Europe from 1 October 2021
• The classification of Copper as Aquatic Chronic 2, effective in Europe from 1 March 2022

These new provisions will apply immediately in England, Scotland and Wales, since the dates of entry into force and compliance with this decision have been set at the day of its publication, 26 June 2024.
