Reused packaging: consultation on the French draft decree

On 16 September 2021, the French Ministry of Ecological Transition launched a public consultation on the draft “Decree on the minimum proportion of reused packaging to be placed on the market annually”. It comes to define the modalities of implementation of two articles of the law on the fight against waste and circular economy (AGEC law) aiming at increasing the share of reused packaging compared to single-use packaging and the minimum proportion of reused packaging to be put on the market.

This draft decree specifies the definition of reused packaging by referring to packaging whose reuse or reutilization is organized by or on behalf of the producer of the packaged product, including for bulk sales or home use if it is a refill device. Cosmetic packaging is not excluded.

The minimum proportion of reused packaging to be placed on the market annually in France is set according to a progressive trajectory from 2022 to 2027:
• -1.5% in 2022
• -5% in 2023
• -6% in 2024
• -7% in 2025
• -8% in 2026
• -10% in 2027

The draft decree specifies the rules for counting sales units for the various categories of packaging. It provides for the possibility of using an equivalent unit of measurement for certain reused packaging (any primary, secondary or tertiary packaging, or 0.5 litres for liquids and 0.5 kilograms in other cases).

Those required to comply with the minimum proportions of reused packaging are producers responsible for placing at least 10,000 units of packaged products on the market per year and declaring an annual turnover in excess of the following values:
• EUR 50 million until 31 December 2024
